Benefits Buddy Terms and conditions
THESE TERMS OF SERVICE (the “Agreement”) GOVERN YOUR RECEIPT, ACCESS TO, AND USE OF THE SERVICES PROVIDED BY ONPOINT PRIVATE WEALTH COACING. (“OnPoint). BY (A) PURCHASING ACCESS TO THE SERVICE THROUGH AN ONLINE ORDERING PROCESS THAT REFERENCES THIS AGREEMENT, (B) SIGNING UP FOR A FREE OR PAID ACCESS PLAN FOR THE SERVICE VIA A PLATFORM THAT REFERENCES THIS AGREEMENT, OR (C) CLICKING A BOX INDICATING ACCEPTANCE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. THE INDIVIDUAL ACCEPTING THIS AGREEMENT DOES SO ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY (“Customer”); SUCH INDIVIDUAL REPRESENTS AND WARRANTS THAT THEY HAVE THE AUTHORITY TO BIND SUCH ENTITY AND ITS AFFILIATES TO THIS AGREEMENT. IF THE INDIVIDUAL ACCEPTING THIS AGREEMENT DOES NOT HAVE SUCH AUTHORITY, OR IF THE ENTITY DOES NOT AGREE WITH THESE TERMS AND CONDITIONS, SUCH INDIVIDUAL MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICES. CAPITALIZED TERMS HAVE THE MEANINGS SET FORTH HEREIN. THE PARTIES AGREE AS FOLLOWS:
Terms of use
Privacy Policy
Each party (the “Receiving Party”) recognizes that the other party (the “Disclosing Party”) may share business, technical, or financial information pertaining to the Disclosing Party’s operations that, due to the nature of the information and the context of disclosure, is reasonably considered confidential (“Confidential Information”). For Chatbase, Confidential Information includes non-public details about features, functionality, and performance of the Service. For Customers, Confidential Information comprises User Information and User Submissions. This Agreement, along with all related Orders, is considered Confidential Information of both parties. However, Confidential Information does not include information that: (a) becomes publicly available without breaching any duty to the Disclosing Party; (b) was known to the Receiving Party before disclosure by the Disclosing Party without breaching any duty; (c) is received from a third party without breaching any duty; or (d) was independently developed by the Receiving Party without using the Disclosing Party’s Confidential Information.

Benefits Buddy helps businesses educate and engage their employees with group benefits and group retirement programs by leveraging AI Chat Agents and cinematic videos.
Accepting the terms
If you’re using the Service, you have to agree to the Terms
In order to use OnPoint’s Service, you need to agree to the Terms. This can be done by simply accessing the Service and consenting when asked. The Terms apply from the commencement of the Service until a time that you cease to use it.
Access to employee benefits plan design and company polices.
To traing your AI Chat Agent, it’s essentail to share information with the service. All data is encrypted.
By sharing your details you grant them permission to aggregate your data, which may then be stored outside of your own country to the extent permitted by applicable law. When we retrieve the information as part of the provision of the Service, we are doing so as your representative and on your behalf and not on behalf of any third-party.
This process means that we are providing Account Information Services (AIS). What this means is that we analyse the data from Neontra, which comes from your various accounts and then display it back to you in different ways and require registration to facilitate this. Neontra will not initiate any payments from your accounts, and you agree that they may use the information for any purpose connected with the Service. We may also on occasion reproduce, distribute, and disclose fully anonymised information at times in the ordinary operation of our business activities.
We do not check the accuracy of the account information and personal information that you provide to us and we rely on you and your account providers to ensure that the information is up to date and accurate. By using the Service, you represent that you are the legal owner of the data in your accounts and that you have the authority to appoint Neontra to access and retrieve the data on your behalf.
Other products and services
OnPoint doesn’t provide support for any other services
In the future, if OnPoint’s Service includes the hosting or linking to related services from other companies, the contract will be between you and the provider of that service. If you have any questions relating to the products or services of a third-party, you should contact the provider directly.
Intellectual Property Rights
We own our Content, and you can’t use it in other places
OnPoint is the owner or the licensee of all intellectual property and Content within our Service. Copyright laws are in place and all rights are reserved.
You can draw the attention of others to Content posted within our Service, and you may print a copy or download extracts from our Service for your personal use, but you must not modify any materials you have printed or downloaded, and you must not use any visuals or audio that have been separated from the accompanying text.
You may not use any materials for commercial purposes without obtaining permission to do so from us or our licensors. Any infringing Content may be removed in accordance with applicable laws. Details of any suspected infringement should directed to tyler@delberatewealth.com
No reliance on information
At times, some parts of our Service might not be up to date
We strive to ensure that all information within our Service is kept up to date at all times, but we make no guarantees or representations that the content within our Service is current, complete, or accurate. You should not rely on the information that we provide or assume that it has taken into account any recent changes in legislation.
Security
Something might happen that we can’t control
OnPoint’s Service is built using the latest technology and the highest security standards as part of our commitment to protect our users. However, we need to be prepared in the event that the Service is compromised by a malicious attack. If the security of the Service, or the safety of user data is compromised, we will inform users immediately via email and implement any safeguards we believe are necessary.
OnPoint cannot be held responsible for any malicious activity caused to your account or device as a result of connecting third-party links to the Service. If you have any concerns about the security of the Service, you should contact us immediately on tyler@delberatewealth.com
Limitation of our liability
Where it is unlawful, there are no exclusions or limitations of our liability to you. This includes liability for death or personal injury caused by our negligence or the negligence of our employees or contractors, and for fraud or any misrepresentation.
We will not be liable to you for any losses or damages if for any reason our Service is unavailable, and we will not be liable for any losses or damages caused by harmful programs or computer code present on your devices that are designed to damage computer software or hardware.
Links to and from our Service
You can link to our Service as long as it doesn’t damage us
If you post, send, or distribute a link to our Service, you must do so legally and make sure it doesn’t damage our Service or brand.
You can’t link to our Service to suggest any endorsement or association without the written consent of OnPoint. We reserve the right to withdraw any linking permission without notice. If we ever provide links to any third-party websites, they should be treated as information only, and we’re not responsible for the content.

At OnPoint, we are committed to the highest operational and ethical standards. We ensure that all of our eligible platform users receive clear, conflict free and personalised financial guidance, free at the point of use.
Our approach in all of our interactions includes clear communication, impartial support and conflict free external signposting where appropriate, ensuring that every user is treated with respect, integrity and due care. We regularly review our services to maintain high standards of fairness and to protect the best interests of our users and customers.
Consumer duty
We are deeply committed to the principles of Consumer Duty. Despite not directly beholden to the regulatory framework in this context, we aim to deliver not just fair but genuinely good outcomes for our users, focusing on the results of our actions rather than merely ticking compliance boxes.
We provide clear, understandable communications in all of our content creation, webinars and coaching calls and ensure that everything is truly understood by the end recipient. We pay special attention to the needs of vulnerable customers and continuously evaluate the value of our services.
Recognising our role within the wider financial ecosystem, we collaborate proactively to ensure positive outcomes across the board. This commitment is ongoing, with regular reviews to ensure we consistently uphold these standards.
Making a complaint
If something’s gone wrong, please let us know
At OnPoint, we work hard to make sure you never have cause to complain about our products or services or how we look after you. Unfortunately, there may be times that we have made a mistake, and we see that as a chance to learn, and to put things right.
We are subject to BC Law and BC Courts, and we take all complaints very seriously while investigating them promptly and fairly. If you would like to make a complaint please contact tyler@delberatewealth.com
How we handle complaints
We investigate as soon as possible and keep you updated
Once we receive your complaint, we will acknowledge it by email. We have a maximum time limit of eight weeks to resolve your complaint, but we will work hard to investigate and reply as soon as possible.
If we can resolve it within 3 business days, we will write to you with a summary and let you know what you can do if you’re unhappy with the outcome. If we can’t investigate and resolve your complaint within 3 business days, we will keep you informed of our progress.
Once we have investigated and completed our assessment, we will send you a final response, which will include the full details of our decision. If you are not happy with our final response, you may refer your complaint to the Insurance Council of BC or the Privacy Comissioner.
Changes to the terms
If we need to update our Terms it will be shown on this page
We will sometimes need to make changes to the terms, which could happen when laws or regulations change, or when we introduce new features, products, or content to the Service. Any new terms will take effect from the next time you use the Service.
When our Terms are updated, the new version will be posted on OnPoint’s Website. This will be done at least two months prior to the changes taking effect If you don’t agree to the new Terms you must stop using the Service. If you continue to use the Service, it will mean that you accept the new Terms.
Data protection policy
It is the policy of OnPoint that all data collected and processed must follow strict rules to ensure privacy, security and compliance with various legal frameworks including PIPEDA.
OnPoint is committed to protecting all data. As part of the firm’s commitment to PIPEDA, OnPoint documents the type of data held on customers, where it came from and who within the firm has access to it. In complying with the principles of PIPEDA, the firm will also process personal data in a legal manner and respond to data breaches.
Personal data
OnPoint collects personal data to provide its service. Only data relevant to the functioning of the service is collected and processed. The type of personal data collected differs depending on the type of service provided. This includes the use of OnPoint’s website, the use of OnPoint’s application (web application and iOS application) and being a customer of OnPoint.
Data required to use the service
OnPoint may collect the following data from users during the signup process. This data is required to provide the service.
Data retention
Data is stored as long as the user and/or customer is using Benefits Buddy We will retain data (like name and email address) that can be used to identify you, as part of our contractual obligations with employers, and to enable and support any future investigations or audits as may be required by law.
Third parties
We do not disclose any Personal Data to any third-party other than to our contracted service providers and business partners that help us deliver the Service.
Where security and data protection procedures are not explicitly detailed, an agreement between the firm and the third party is drawn up and signed to cover all scenarios.
Training and monitoring
OnPoint’s is responsible for making sure all employees of OnPoint are familiar with the data protection procedures set out in this document. This will be done through an onboarding session for new employees, and a yearly training course for existing employees.
All OnPoint employees’ access to systems and devices will be monitored to ensure the principle of least privilege is maintained. Where an employee accesses data that is not needed for the role, access will be removed and an audit will be conducted.
